The present general conditions of sale are concluded between YAY - You Are Young, registered under the SIRET number 797 548 955 00039, head office established at 26 rue Pastourelle 75003 Paris, EURL with a capital of 500€, registered with the Chamber of Trades and Crafts of Paris, hereinafter referred to as the "seller", and any individual or legal entity wishing to proceed with a purchase via the website www.yay.paris, hereinafter referred to as the "customer".

Object

The acquisition of a good via the site www.yay.paris implies an acceptance without reserve by the purchaser of the present conditions of sale.
These conditions of sale will prevail over any other general or particular conditions not expressly agreed by the seller.
The seller reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force at the date of the order by the buyer.
Characteristics of the proposed products
The products offered are listed on the site www.yay.paris. Each product is accompanied by a description and photographs. The photographs are chosen to be the most faithful possible, but cannot ensure a perfect similarity with the product offered, in particular concerning the colors. Moreover, the jewels being all hand made by the creator, each piece is unique and can vary slightly from the photographs.

Geographical zone

The online sale of the articles presented in the site is reserved for the purchasers who reside in Metropolitan France, in the Dom-Tom or in Monaco and for deliveries required in these geographical zones.

Prices

The prices are indicated in euros including VAT. The applicable VAT rate is the one in effect on the day of the order. However, YAY reserves the right to pass on to the Customer any change in the VAT rate applicable to the order.
The seller reserves the right to modify its prices at any time. However, it undertakes to invoice the goods ordered at the price indicated when the order is registered.
The prices indicated do not include the costs of order processing, transport and shipping.

Orders

The customer places an order on the website " www.yay.paris ".
To purchase one or more items, he/she must follow the following ordering process:
- Choice of the articles and addition to the basket
- Validation of the contents of the basket
- Registration on the identification form on which he will indicate all the requested information
- Choice of payment method
Validation of the payment

The customer will receive an order confirmation e-mail.
The customer will be able to view the details of his or her order and its total price at any time during the ordering process and correct any errors before confirming it to express his or her acceptance.

YAY - You Are Young reserves ownership of the items until the order is paid in full, i.e., until YAY - You Are Young has received payment for the order.
YAY - You Are Young reserves the right to cancel or refuse any order from a Customer with whom there is a dispute over payment of a previous order. Any order implies acceptance of the prices and descriptions of the items available for sale.
YAY - You Are Young commits to honor the orders received on the website only within the limits of available stocks.

Payment

The buyer makes his payment :
- By Paypal, either via his Paypal account, or via a secure payment by credit card
- By credit card via Payplug, which uses a secure protocol so that the information transmitted is encrypted by software and no third party can read it during transport on the network.

If you pay your order in several times, you accept the general conditions of Alma's customers as well as the particular conditions of Alma for the customers of YAY Paris.

Shipping and delivery times

All orders placed on the YAY - You Are Young website will be prepared and shipped within one to three days following the order, subject to payment validation.
YAY - You Are Young undertakes to deliver the orders placed by the Customer within the specified time.

The delivery time is estimated at three to ten days after receipt of payment.
Any reasonable delay in the delivery of the products will not give rise to the allocation of damages or the cancellation of the order for the benefit of the buyer.

Orders are shipped by registered mail.
The customer is required to check the good condition of the delivered items. Any anomaly noted (missing item, damaged package, broken item ...) must be indicated within 4 days of receipt.

Withdrawal

In accordance with article L.121-16 of the French Consumer Code, for all transactions and distance sales, the buyer, a non-professional individual, benefits from a fourteen-day withdrawal period from the delivery of his order to return the product to the seller, provided that the product has not been worn, for exchange or refund without penalty, with the exception of the return costs and additional costs arising from the fact that the Customer has chosen, where applicable, a method of delivery other than the less expensive standard method of delivery offered by YAY.

Responsibilities

The seller cannot be held liable if the non-performance or delay in the performance of any of its obligations described in these general terms and conditions of sale is due to a case of force majeure.
In this respect, force majeure means any external, unforeseeable and irresistible event within the meaning of Article 1148 of the Civil Code.
The responsibility of the seller can also not be implemented in the case of disruption or total or partial strike of postal services.

Intellectual property

All the elements of the site www.yay.paris are and remain the intellectual and exclusive property of the seller. Nobody is authorized to reproduce, exploit, rebroadcast, or use in any capacity whatsoever, even partially, elements of the site.
Archiving / Proof
The seller will file the purchase orders on a reliable and durable support constituting a faithful copy in accordance with the provisions of article 1348 of the Civil code. The computerized records of the seller will be considered by the parties as proof of communications, orders, payments and transactions between the seller and the buyer.

Settlement of disputes

The present conditions of sale on line are subjected to the French law. In the event of litigation, jurisdiction is attributed to the competent courts of Paris, notwithstanding multiple defendants or appeal in warranty.
