Terms of sale

The present general conditions of sale are concluded between YAY - You Are Young, registered under the n° of SIRET 797 548 955 00039, head office established at 5 cité de la roquette 75011 Paris, EURL with a capital of 500€, registered at the Chamber of trade and craft of Paris, hereafter called the "salesman", and any physical or moral person wishing to proceed to a purchase via the Internet site www.yay.paris, hereafter called the "customer".

Object

The acquisition of a good via the site www.yay.paris implies an acceptance without reserve by the buyer of the present conditions of sale.
These conditions of sale will prevail over any other general or particular conditions not expressly agreed by the seller.
The seller reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force at the date of the order by the buyer.
Characteristics of the proposed products
The products offered are listed on the site www.yay.paris. Each product is accompanied by a description and photographs. The photographs are chosen to be the most faithful possible, but cannot ensure a perfect similarity with the product offered, in particular concerning the colors. Moreover, the jewels being all hand made by the creator, each piece is unique and can vary slightly from the photographs.

Geographical area

The online sale of the articles presented in the site is reserved for the purchasers who reside in Metropolitan France, in the Dom-Tom or in Monaco and for deliveries required in these geographical zones.

Prices

The prices are indicated in euros including VAT. The applicable VAT rate is the one in effect on the day of the order. However, YAY reserves the right to pass on to the Customer any change in the VAT rate applicable to the order.
The seller reserves the right to modify its prices at any time. However, it undertakes to invoice the goods ordered at the price indicated when the order is registered.
The prices indicated do not include the costs of order processing, transport and shipping.

Orders

The customer places an order on the website " www.yay.paris ".
To buy one or more items, he must follow the following ordering process:
- Choice of the articles and addition to the basket
- Validation of the contents of the basket
- Registration on the identification form on which he will indicate all the requested information
- Choice of payment method
- Validation of the payment

The customer will receive an order confirmation e-mail.
The customer will be able to view the details of his order and its total price at any time during the ordering process and correct any errors before confirming it to express his acceptance.

YAY - You Are Young reserves ownership of the items until the order is paid in full, i.e., until YAY - You Are Young has received payment for the order.
YAY - You Are Young reserves the right to cancel or refuse any order from a Customer with whom there is a dispute over payment of a previous order. Any order implies acceptance of the prices and descriptions of the items available for sale.
YAY - You Are Young commits to honor the orders received on the website only within the limits of available stocks.

Payment

The buyer makes his payment :
- By Paypal, either via his Paypal account, or via a secure payment by credit card

If you pay your order in installments, you accept the general conditions of Alma's customers as well as the special conditions of Alma for YAY Paris customers.

No payment by check, cash or bank transfer.

Shipping and delivery times

Any order placed on the site of YAY - You Are Young will be prepared and shipped between one to two day(s) following the order, subject to validation of payment.

YAY - You Are Young commits to deliver the orders placed by the Customer within the specified timeframe.

The delivery time is estimated at three to ten days after receipt of payment.
Any reasonable delay in the delivery of the products will not give rise to the allocation of damages or the cancellation of the order for the benefit of the buyer.

Orders are shipped by Colissimo or Chronopost.
The customer is required to check the good condition of the delivered items. Any anomaly noted (missing item, damaged package, broken item ...) must be indicated within 4 days of receipt.

Withdrawal

In accordance with article L.121-16 of the French Consumer Code, for all distance selling transactions, the buyer, a non-professional individual, benefits from a fourteen-day retraction period from the delivery of his or her order to return the product to the seller, provided that the product has not been worn, for exchange or reimbursement without penalty, with the exception of return shipping costs and additional costs resulting from the fact that the Customer has chosen, where applicable, a delivery method other than the less expensive standard delivery method offered by YAY.

Warranty

Legal guarantee of conformity

The buyer benefits from the legal guarantee of conformity for 2 years in case of manufacturing defects at the time of purchase.

24 months commercial warranty

We take in charge the repair or the replacement of any damage on the jewel intervening in the 24 months following the purchase.

The 24 months warranty does not cover:

1/ the natural aging of the jewelry: deposit of impurities on the jewelry, natural tarnishing of the metal or stones.
During the life of the jewel and with daily use, it can happen that impurities get stuck in the pearls, stones, clasps. In this case, we suggest you proceed to a cleaning of the jewel by following our advice.

2/ cleaning 925 silver
Your 925 silver jewelry can turn yellow or black when not worn. If this happens, don't panic, follow our cleaning advice or go to the store if you prefer to have it taken care of.

3/ resizing (rings, bracelet, necklace)
You bought your ring in the summer and it becomes a bit big in the winter, the chain has become a bit loose with use, you want to shorten your necklace, enlarge your bracelet. We understand all these problems but they are not covered by our warranty. We can offer you to intervene on estimate, do not hesitate to contact our WeCare team

4/ lost jewelry
Unfortunately in case of lost jewel, we cannot apply any guarantee.

Conditions of the guarantee :

  • For any warranty coverage we will ask you for a proof of purchase < 24 months
  • Our guarantee covers purchases made on the website www.yay.paris, in a store or at our retailers
  • Our guarantee does not cover purchases made at physical or online sales

DIYAY Workshop" conditions

DIYAY workshops are non-refundable once the event is over.
The jewelry made during the workshop is not subject to the 24 months commercial warranty but we commit ourselves to repair the jewelry if it breaks within 30 days after the workshop.

Responsibilities

The responsibility of the seller cannot be implemented if the non-execution or the delay in the execution of one of its obligations described in the present general conditions of sale results from a case of force majeure.
In this respect, force majeure means any external, unforeseeable and irresistible event within the meaning of Article 1148 of the Civil Code.
The responsibility of the seller can also not be implemented in the case of disruption or total or partial strike of postal services.

Intellectual property

All the elements of the site www.yay.paris are and remain the intellectual and exclusive property of the seller. No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the site.

The seller will file the purchase orders on a reliable and durable support constituting a faithful copy in accordance with the provisions of article 1348 of the Civil code. The computerized records of the seller will be considered by the parties as proof of communications, orders, payments and transactions between the seller and the buyer.

Settlement of disputes

The present conditions of sale on line are subjected to the French law. In the event of a dispute, jurisdiction is attributed to the courts of Paris, notwithstanding multiple defendants or warranty claims.

In accordance with the provisions of the French Consumer Code, the customer has the right to have free recourse to the approved consumer mediator proposed by yay, in the event that a dispute cannot be settled after a prior complaint by the customer to yay's customer service department.
